Terms of Use

These terms apply to your use of our website at gkcocean.com and our client portal at track.gkcocean.com (together, the "Site"), operated by GKC Ocean Shipping Line LLC ("GKC Ocean Shipping Line", "we", "us"), a licensed non-vessel operating common carrier (FMC OTI License No. 034532N). By using the Site you agree to these terms. Our Privacy Policy explains how we handle information.

Important: these terms cover using the website and portal. The transportation services themselves are governed by our bill of lading terms and conditions, our published FMC tariff (Tariff No. 001, available through Paramount Tariff Services), and any written agreement or terms and conditions of service that apply to your shipment. If anything here conflicts with those documents, those documents control.

1. Quotes and bookings

Information on the website is general and may change. A quote request is not a booking. Rates, schedules and transit times we send are estimates based on the information you provide and current market conditions, and are subject to our tariff, carrier and space availability, and the terms of the quote. A shipment is booked only when we confirm it.

2. The client portal

Access by invitation. Portal accounts are created by GKC Ocean Shipping Line for our customers and their authorized staff. Accounts are for business use.
Keep your sign-in secure. You are responsible for activity under your account. Use a strong, unique password, do not share your sign-in, and tell us right away at info@gkcocean.com or 877-494-2424 if you think your account has been misused.
Your company's people. You agree to tell us when someone with access leaves or should no longer have access, so we can remove it.
We may limit or remove access to protect the security of the portal or our customers, if these terms are broken, or when our business relationship ends.
The portal is free for our customers. We may set reasonable limits, for example on the number of shipments you track yourself, and we may change or discontinue features.

3. Tracking information and ETAs

Shipment status, vessel, ETA and other tracking information in the portal comes from ocean carriers, terminals and third-party data providers, and may be delayed, incomplete or wrong. ETAs and other dates are estimates and can change. Please confirm critical dates (such as cargo cut-offs, arrival and pickup) with your GKC Ocean Shipping Line coordinator before relying on them. We are not responsible for losses caused by reliance on tracking information.

4. Documents, invoices and statements

Documents, invoices and statements in the portal are provided for your convenience. The amounts you owe are governed by our invoices and the terms that apply to your shipments. Bank and payment details are never changed by email; always confirm payment instructions by calling us at a number you already know before sending money.

5. Acceptable use

You agree not to:

try to access accounts, information or systems you are not authorized to use;
interfere with, overload or attack the Site, or try to bypass its security;
use automated tools to scrape or copy the Site, except tools we provide (such as exports);
upload anything unlawful, harmful or containing viruses or other malicious code;
use the Site in a way that breaks any law or regulation, including export control and sanctions laws.

6. Your content

You keep ownership of the documents and information you upload. You allow us to store, process and share them as needed to provide our services, including with carriers, customs brokers, authorities and other parties involved in your shipments. You confirm you have the right to provide them and that they are accurate.

7. Our content

The Site, including its design, text, graphics and software, belongs to GKC Ocean Shipping Line or its licensors. Carrier names and logos belong to their owners and are shown to identify the lines we book with. You may not copy or reuse the Site except to use it as intended.

8. Third-party links and services

The Site links to and relies on services run by others (for example tariff publication, mapping and tracking providers). We are not responsible for their content or availability.

9. No warranty

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind about the Site, including that it will be uninterrupted, error-free or always available, or that its information is complete or accurate.

10. Limitation of liability

To the fullest extent permitted by law, GKC Ocean Shipping Line will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US$100). This section does not limit liability that cannot be limited by law, and it does not change the liability terms that apply to transportation services under our bill of lading, tariff and terms and conditions of service.

11. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules, except where federal law (including the Shipping Act) applies. Any dispute relating to the Site will be brought in the state or federal courts located in Gwinnett County, Georgia.

12. Changes

We may update these terms. The date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated terms.
